As a licensed operator of UAV’s (Unmanned Aerial Vehicles) High Compliance Ltd is regulated by the Civil Aviation Authority or CAA.

It is essential for us to adhere to these regulations for our Pilot’s licenses, (PFCO), insurance and public liability cover to be valid. We will assess each Shoot, in the form of a documented Risk Assessment.

• We require the permission of the landowner to take off and land
• We cannot fly directly over people, roads & buildings which are not under the control of the film crew and require a minimum of 50 meters distance from these objects.
• Certain restrictions apply to certain areas and additional permissions to fly may need to be sought from the CAA
• If we are to be flying near an airport or airfield, we will need to contact local Air Traffic Control to check with them that it is safe to operate at a certain height on a specified date and time
• Often it is necessary to perform a pre-shoot Recce of a location
• The Pilot always has the final say if flying conditions and locations are acceptable
• Under law, all photographs and video taken by High Compliance Ltd belongs to and is copyright of High Compliance Ltd. The client retains the rights to use the material as the client wishes but unless prior agreement is made with High Compliance Ltd, cannot resale the material. If the client requires exclusive rights to any material the client must clearly state that and a contract agreement be made with the copyright owner.

Our pilots have attended an accredited course with NQE (National Qualified Entity) status from the CAA (Civil Aviation Authority) facilitating operators and companies the ability to obtain a Permissions For Aerial Work (PFAW) now called (PFCO).

SECTION 5.1 – PRODUCTS OR SERVICES FREE TRIALS

We reserve the right not to accept a request for a free trial.

Topographical and 3D mapping trials are governed by size of area there will also be a limit on the data we will provide, these will be identified and discussed with you after we accept your request for a free trial.

We reserve the right to use any information, video or other content produced for internal and external marketing uses.

SECTION 5.2 – ONSITE ASSET LIABILITY

Equipment, facilities and resources

Any equipment supplied to our clients/ customers to satisfy a contract/ PO/ agreement of work that cannot be reasonably secured and monitored by High Compliance on a continual basis will therefore become the responsibility of the client/ customer. This responsibility extends to the client/ customer to ensure the security and safety of the equipment. Where the security or safety of the equipment is breached, for example theft or damaged by site activities then High Compliance will seek compensation from the clients/ customers insurance company.

For example, timelapse cameras and off grid solar power devices.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our web-site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 6a – PAYMENT OF INVOICES

• Invoices must be paid within thirty days from the date of the invoice.
• The company reserves the right to charge a one off 8% surcharge on the full amount for late payments received after the due date.
• Under the Commercial Debts (Interest) Act 1998 interest will also be charged on any overdue amount at the rate of 8% above and including the Bank of England base rate from time to time in force per annum.

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
